The answer to his question I believe is no, it should not effect the K8 chips performance. since the bug has to do with the Phenom's TLB and L3 cache, something the K8's don't have.
I did never say it was not a legit question, but there is always a risk in switching between CPU and if you had use search on this site you would see how many that have damaged their CPU from the first socket A until now just because they wanted to try out something.
My point was to reduce that kind of unnecessary switching between CPU back and forth.
The second problem I have with your first and only post on this site are that you don't show any respect and just throw out some speculation about K10 have L3 cache and K8 do not and from that point draw a conclusion that it will not effect Athlon64 X2 6400+. We don't know for sure as there are really not many that have tested this yet and what is theoretical possible is not always what happen in real situation.
Here is an example of what can happen:

Update: Now the true problem is making it's self known. I noticed on my previous OS that I was getting a stall right after the welcome screen and had to wait a moment before startup apps would launch. Generaly this is a driver issue specific behaviour. So the clean install would fix it, so I paid little attnetion to it. Then I noticed it doing it again in the clean install. I also noticed strang results again in PcMark. One test scored 1767, and the next 7509. After still having trouble with the clean instal and plenty of testing, I decided something is definately not right, so I removed the 6400+ and put back in the box, ready to go back for RMA. I put the 5200+ back in and guess what, it's doesnt post! Clear CMOS, still doesnt post. Remvove cmos battery...still no post. Powers up but no post. I stick the 6400 back in and I its doesnt post, but still powers on. Now I need to put the motherboard on the bench and test it to see if something blew on it. I'll test the processors tomorrow in another system, Im betting they will work fine in that system. I remember hearing people mention something about the 0904 bios ruining hardware, well this might be the case, because I did upgrade my bios before I installed the 6400+, and then downgraded after it started acting weird. Lets hope the Crosshair test ok tomorrow, its a great and expensive motherboard to have to trash because of a bios issue.
I'll be looking at new motherboard replacements tonight just incase. Iguess I'll check the FutureMark Orb database for top clocking AMD motherboards.

kakasnarta: I suggest you talk with kazgirl on this site. She have experience with both Phenom and Athlon64 X2 6400+ and she could tell you how this work in real world from her own experience.
