The legacy 4xxx series of cards do not meet the minimum requirements for Windows 8.1. Only the 5xxx series and above work. The cards do not meet the minimum requirements for Windows 8 either, but Windows 8 is more forgiving and reports are that the 4xxx series work, to a dimished degree.
Also keep in mind, that compaired to a desktop computer, laptops do not have much flexibility. The first thing a person should do when wanting to 'upgrade' to Windows 8 or 8.1 is to check with the laptop manufacturer to see if the laptop will even support it. Some that do, require a bios update. Most older laptops will not...no matter what Microsoft says.
