I am running a new system and with the latest beta drivers and catalyst 13.9 and all I get is atrifacting while playing Battlefield 4 - its ok to start with and then its starts - no amount of setting changes makes any difference.

I have had to uninstall the driver and load on cataylst 13.6 to get back to a stable system.

I am running:

Toxic R280X

AMD 8350 Black Edition CPU

16GB Ram

Win 7 64bit

Is this a problem with teh beta drivers or is my card borked?

Artifacting -> faulty hardware -> RMA it.

If it occurs on multiple drivers and multiple games, and you are supplying it with enough power, and your case has adequate airflow, then RMA. If not then it is not a problem with the card.
